MASTER YOGA CERTIFICATION TERMS AND CONDITIONS (OFFLINE DELIVERY)

The following terms are accepted by any teacher trainee when the first payment is made on account of fees payable as a Teacher Trainee.

Teacher Training Program costs will be as set out on this site at the time of purchase.

You accept the following terms (with “I” or “you” referring to you, the teacher trainee or franchisee, or both, as the case may be, being the person who makes the payment, whether such payments are made online or offline).

I understand and accept that if I withdraw from the program within 7-days or less from the program commencement date, for whatever reason (including illness and/or injury), that I am not entitled to a refund. If I am on the Payment Plan the same will apply. More precise information on refund periods are in the agreement below.

I understand and accept that if I breach the rules of the studio and/or teacher training, including points itemized from Teacher Trainee Agreement & Teacher Trainee Requirements, I will be dismissed from the program prior to completion, I understand that I will be not entitled to a refund.

HOT YOGA TEACHER TRAINING AGREEMENT

This Hot Yoga Teacher Training Agreement (“Agreement”) is a legal contract between you as Teacher Trainee and Peak Physique Hot Yoga (“PP”).

By entering into this Agreement or by beginning the Hot Yoga Teacher Training (“Training”), you agree to be bound by the conditions of this Agreement, including the Warranty Disclaimers, Limitations of Liability and Termination and Restraint of Trade Provisions below.

  1. I have been examined by a licensed medical (“Practitioner”) within the past 3 months and have been found by such Practitioner to be able to perform all vigorous stretching and the Yoga Exercises which I am able to perform during my Training with “PP”.
  2. I will faithfully follow all instructions given to me by PP and it’s teachers, as to when, where and how to perform and not to perform the Yoga Exercises.
  3. I agree that if I become aware of a change in medical condition during the term of the Training Agreement that PP be notified immediately.
  4. I understand and acknowledge that this course does not provide me with automatic employment with PP or outside of PP studios.
  5. I agree and acknowledge that participation in any Yoga Exercises could constitute a risk of serious injury to myself, including permanent paralysis or death. I voluntarily and knowingly recognize, accept & assume this risk & warrant that I am physically fit and able to perform the Yoga Exercises without risking serious injury, including permanent paralysis and death. I acknowledge that neither PP, it’s owners, teachers, contractors or employees of PP shall be, nor deemed to be responsible or liable (whether in contract or in tort or any other statute whatsoever). For any injury, illness or other mishap I sustain arising from or out of, or in any way directly or indirectly connected with the Yoga Exercises.
  1. I understand and acknowledge that I am able to receive instruction in Yoga Exercises and Training theory only. PP, it’s owners, teachers, contractors and employees of PP are not liable for, nor expected to provide any advice or medical assistance other than in the form of the Training.
  2. I understand and acknowledge that my Training may be terminated without refund at any time, should I fail to meet the Training Requirements, Etiquette of the Studio; Breach Training and/or PP Confidentiality; steal, cheat, lie: and/or if I am found to have not disclosed my medical condition or a change in my medical conditions before or during the Training.
  1. I have agreed to the Refund Policy and understand that the tuition paid by me under this Training to PP is non-refundable if I withdraw from the course within 7 days of the course commencement or after the course has commenced. PP may in it’s sole discretion grant refunds to me without prejudicing any of it’s rights.
  2. Disclaimer of Warranty: PP shall have no liability to me as a result of, or arising out of, the Training or any services provided, including any liability for negligence. PP and I received no warranties, express, implied, statutory or in any other provision of the Agreement or any other communication and PP specifically disclaims any warranty or merchantability or fitness for a particular purpose.
  3. Waiver of Liability: I waive any and all claims, and agree not to hold PP, it’s owners, teachers, contractors or employees of PP from and against all actions, suits, causes of action, proceedings, claims, costs and expenses whatsoever which may be taken or made against PP (whether in contract or in tort or any other statute whatsoever), it’s owners, teachers, contractors or employees of PP in connection with or arising out of any such injury, illness, mishap to me or loss I may incur which may be caused party or entirely due to my negligence, misrepresentation or any breach made by me, non-disclosure or my Termination from the Training.
  4. Indemnification: I indemnify and will at all times hereafter well and sufficiently indemnify and keep fully indemnified PP, it’s owners, teachers, contractors or employees of PP from and against all actions, suits, causes of action, proceedings, claims, costs and expenses whatsoever which may be arising out of or resulting from my breach of any provision of this Agreement; my negligence, recklessness or wilful misconduct; my assertion of a claim contrary to the Waiver of Liability section of this Agreement.
  5. On completion of my Hot Yoga Teacher Training at Peak Physique Hot Yoga I agree to the ‘restraint of trade’. That is, I cannot teach hot yoga (in or out of a hot room) or open a studio in the area comprised of a radius of 5 kms from Peak Physique Hot Yoga Seaton, Peak Physique Hot Yoga Prospect or a Peak Physique Hot Yoga Franchise for a period of 12 months without prior written consent from Peak Physique Hot Yoga.

By completing any purchase or paying a deposit, whether such payment is made online or offline I agree to these terms and conditions.

TEACHER TRAINEE REQUIREMENTS DURING YOGA TEACHER TRAINING PROGRAM

  1. Times

Teacher Trainees must abide by the following:

Study Lecture: arrive at least 5 mins before class start time

Posture Clinic: arrive at least 5 mins before class start time

Teaching Classes: arrive at least 20 mins before class start time

After Class: allow at least 10–15mins after class end time

It is your responsibility to maintain punctuality at all times.

Practical class teaching to real students

Consistent signed in practice 6 per week (or otherwise certified with PP agreement)

Home self paces practice

In teaching classes, GoPro recording teaching will be used for teacher & trainee self-feedback.

  1. Illness 

100% attendance is required

Medical certificate is required if you are unable to attend within 48 hours

  1. Mobile Phones 

All Mobile Phones need to be turned off.

  1. Philosophy

Students are expected to abide by the Studio’s philosophy, Teacher Training rules at all times.

  1. Confidentiality

As teacher training is occurring at the studio, you will be required to maintain confidentiality regarding but not limited to:

  • Teacher Training
  • Studio Matters
  • Studio procedures and business procedures
  • Student disclosure.
  1. Studio Usage & Contents

The studio or other training halls are only to be used for yoga or teacher training purposes. All studio items are to remain on site at all times.

  1. Food and Rubbish

No food is to be brought into the studio due to the hygienic nature of the business and any personal rubbish is to be removed at the end of the day.

  1. Dress Code and Hygiene

Appropriate yoga or casual clothing is required during lectures and classes. Professional yoga clothes are required to be worn when teaching a class. Due to the hot nature of the yoga, hygiene levels & presentation must be maintained at a professional level (including but not limited to: showered, clean hair, fresh breath, deodorized, light makeup if any etc…).

  1. Class Preparation

It is your responsibility to be prepared for each class and to have posture instruction and class homework ready when required, without excuse.

RISKS, CANCELLATIONS AND INSURANCE

Peak Physique Hot Yoga shall not be responsible for any injuries, losses or damages in connection with accommodation, flights, other facilities at teacher training resort, ground transportation, disease, local laws, climatic conditions, Acts of God, delays, changes or cancellation of travel due to weather conditions, accidents or health related problems while training with Peak Physique Hot Yoga and while in transit to (e.g. an accident on the way to training), during and after training. It is the traveller’s responsibility to obtain appropriate insurance coverage against these risks any other not stated above.

If travel plans are delayed or cancelled for any reason there will be no refunds issues by Peak Physique Hot Yoga except as stated herein.

We specifically recommend that foreigners entering abroad do so with valid passport expiring more than 6 months following the departure date, you could be refused entry if this condition is not met.

Peak Physique Hot Yoga is not responsible for expenses incurred in preparation for any cancelled trips by a guest such as airline tickets or for costs incurred due to travel delays, flight cancelation or illness.

Cancellation by Peak Physique Hot Yoga 

Peak Physique Hot Yoga will do its utmost to maintain its standard of never cancelling a training course, but if for some unforeseen reason Peak Physique Hot Yoga were ever to cancel a teacher training course, guests are welcome to move teacher training dates or their payment refunded in full, Payment of your deposit indicates your agreement to the cancelation policy.

Cancelations by guests

A non-refundable deposit of at least AUD $300 may be requested to secure your booking. The remainder is to be paid 30 days prior to the event. Prices do not include accommodation, flights, transfers and food unless otherwise stated in the training information.

Cancelation – Depending on when you cancel, cancelation penalties may apply. Fees are determined by the following schedule.

For cancelations made more than 90 days prior to teacher training start date, 100% deposit payment may be applied to another teacher training.

For cancellations made between 89 and 31 days to teacher training start date, 50% of your deposit payment may be applied to another teacher training.

If you cancel 30 days or less before the teacher training start date, the entire of the deposit is non-refundable.

This Master Yoga Certification Online Course Agreement (“Agreement”) is a legal contract between you ………………………………………………………………. And Peak Physique Hot Yoga (“PP”).

By entering into this Agreement or by beginning the Master Yoga Certification Online Course (“Online Training”), you agree to be bound by the conditions of this Agreement, including the Warranty Disclaimers, Limitations of Liability and Termination and Restraint of trade Provisions below.

For any injury, illness or other mishap I sustain arising from or out of, or in any way directly connected with Yoga exercises.
  6. I understand and acknowledge that I am able to receive instruction in Yoga exercises and Online Training theory only. PP, it’s owners, teachers, contractor and employees of PP are not liable for, not expected to provide any advice or medical assistance other than in the form of the Online Training.
  7. I understand and acknowledge that my Online Training may be determined without refund at any time, should I fail to meet the Training Requirements, Etiquette of the studio; Breach Training and/or PP Confidentiality; steal, cheat, lie: and/or if I am found to have not disclosed my medical condition or change in my medical condition before or during the Online Training.
  8. I understand the Online Delivery Course is Non-Refundable or Transferrable.
  9. I have agreed that this his Online training course is non-refundable at any time.
  10. Disclaimer of Warranty: PP shall have no liability to me as a result, or arising out of, the Online Training or any services provided, including any liability for negligence. PP and I receive no warranties, express, implied, statutory or in any other provision of the Agreement or any other communication and PP specifically disclaims any warranty or merchantability or fitness for a particular purpose.
  11. Waiver of liability: I waive any and all claims, and agree not to hold PP, it’s owners, teachers, contractors or employees of PP from and against all actions, suits, causes of action, proceedings, claims, costs and expenses whatsoever which may be taken or made against PP (whether in contract or in tort or any other statute whatsoever), it’s owners, teachers, contractor or employees of PP in connection with or arising out of any such injury, illness, mishap to me or loss I may incur which may be caused party or entirely due to my negligence, misrepresentation or any breach made by me, non- disclosure or my termination from the Online Training.
  12. Indemnification: I indemnify and will at all times hereafter well and sufficiently indemnify and keep fully indemnified PP, it’s owners, teachers, contractor or employees of PP from and against all actions, suits, causes of actions, proceedings, claims, costs and expenses whatsoever which may be arising out of or resulting from my breach of any provision of this Agreement; my negligence, recklessness or wilful misconduct; my assertion of a claim contrary to the Waiver of Liability sections of this Agreement.
  13. On completion of my Master Yoga Certification Online Course at Peak Physique Hot Yoga I agree to the ‘restraint of trade’ i.e. I cannot teach yoga (in or out of a hot room) or open a studio in the area compromised of a radius of 15kms, 10kms or 5kms from a Peak Physique Hot Yoga Franchise for a period of 1 year without prior written consent from Peak Physique Hot Yoga.

RISKS, CANCELLATIONS AND INSURANCE

The Peak Physique Hot Yoga shall not be responsible for any injuries, losses or damages in connection with computers, phones, mats, notebooks, stationary, during and after training. It is the trainee’s responsibility to obtain appropriate insurance coverage against these risks any other not stated above.

We will not be responsible for your expenses occurred if instant dismissal has occurred from your miss-conduction.
